1. INTRODUCTION
Welcome to the CABZ platform. These Terms of Use ("Terms") govern your use of our mobile application and related services.

IMPORTANT: By using our application and services, you accept these Terms of Use. If you do not accept these terms, please do not use our application.
2. DEFINITIONS
- "Application" - CABZ mobile application available on iOS and Android platforms
- "Platform" - CABZ platform that connects Passengers with Drivers
- "Passenger" - A person who uses the application to request transportation
- "Driver" - A person who provides transportation services through the platform
- "Service" - The service of connecting Passengers with Drivers through the platform
- "Ride" - Transportation service between two locations
- "We", "Us", "Our" - MUŠKAT d.o.o.
- "You", "Your" - Application user (Passenger or Driver)
3. NATURE OF SERVICE
CABZ is a platform that connects Passengers with Drivers. We are not a transportation service provider. We do not own vehicles, employ drivers, or provide transportation services. We are merely an intermediary between Passengers and Drivers.
The transportation service between Passenger and Driver constitutes a direct contract between them. CABZ is not a party to that contract and bears no responsibility for the behavior, actions, or omissions of the Driver or Passenger.
4. REGISTRATION AND ACCOUNT
4.1. Passengers
- You must be at least 16 years old to use the application
- You must provide accurate and complete information during registration
- You are responsible for maintaining the security of your account and password
- You must immediately notify us of any unauthorized use of your account
- You may not share your account with other persons
4.2. Drivers
- You must be at least 18 years old
- You must possess a valid driver's license
- You must possess a professional taxi permit (Dozvola) issued by competent authorities
- You must possess a registered and insured vehicle that meets all legal requirements
- You must provide all necessary documents (driver's license, taxi permit, vehicle registration, insurance)
- You must pass background checks and approval by CABZ
- You are responsible for ensuring all your documents are valid and up to date
5. USE OF APPLICATION
5.1. General Rules
- You may not use the application for illegal purposes
- You may not interfere with or disrupt the application's functionality
- You may not attempt to access parts of the application for which you do not have permission
- You may not use the application in a way that could damage, disable, or overload our infrastructure
- You may not use the application to transport illegal items or substances
5.2. Passenger Behavior
- You must be polite and respectful to the driver
- You may not damage the driver's vehicle
- You must be punctual
- You must pay for the ride according to the agreed price
- You may not ask the driver to violate traffic regulations
5.3. Driver Behavior
- You must be polite and respectful to passengers
- You must drive safely and in accordance with traffic regulations
- You must maintain the vehicle in good condition
- You may not discriminate against passengers
- You must accept the ride after it has been accepted in the application (except in exceptional circumstances)
- You must use the shortest or fastest route unless the passenger requests otherwise
6. PRICING AND PAYMENT
6.1. Pricing
- Ride prices are determined dynamically based on various factors (distance, time, driver availability, weather conditions)
- The price is displayed before confirming the order
- We reserve the right to change prices at any time
- The final price may differ from the estimated price due to route changes, waiting time, or other factors
6.2. Payment Methods
- Cash
- Apple Pay
- Google Pay
- Credit/debit card (through the application)
6.3. Refunds
- Refunds are considered in case of application errors or defective service
- Refund requests must be submitted within 48 hours of ride completion
- We reserve the right to refuse refunds if we consider the request unjustified
7. CANCELLATION OF RIDES
7.1. Cancellation by Passenger
- Passengers may cancel a ride before the driver arrives without charge
- A cancellation fee may be charged if the driver is already en route to the pickup location
- The cancellation fee depends on the cancellation time and driver distance
7.2. Cancellation by Driver
- Drivers may cancel a ride in exceptional circumstances (e.g., emergency, accident)
- Frequent ride cancellations may result in account suspension or closure
- Drivers are obligated to accept the ride after it has been accepted in the application
8. LIMITATIONS OF LIABILITY
IMPORTANT: CABZ acts only as an intermediary. We bear no responsibility for:
- Ride safety or driver behavior
- Loss or damage to passenger property
- Damage to driver's vehicle
- Delays or route changes
- Accidents or incidents during the ride
- Data loss or financial loss due to technical problems
CABZ's maximum liability is limited to the amount of commission we received for the individual ride.
9. INTELLECTUAL PROPERTY
- All application content (logo, design, text, software) is the property of MUŠKAT d.o.o. or our licensors
- You may not copy, modify, or distribute application content without our written consent
- You may not use our logo or trademarks without permission
10. ACCOUNT SUSPENSION AND CLOSURE
We reserve the right to suspend or close your account in the following cases:
- Violation of these Terms of Use
- Illegal behavior
- Application abuse
- Providing false information
- Non-payment or fraud
- Inappropriate behavior towards other users
11. CHANGES TO TERMS
We reserve the right to change these Terms of Use at any time. We will notify you of significant changes via the application or email. Continued use of the application after changes constitutes acceptance of the new terms.
12. APPLICABLE LAW AND DISPUTE RESOLUTION
- These Terms of Use are governed by the laws of the Republic of Croatia
- All disputes will be attempted to be resolved amicably
- If a dispute cannot be resolved amicably, the competent court in the Republic of Croatia has jurisdiction
- Before filing a lawsuit, there is an obligation to attempt to resolve the dispute through alternative methods (e.g., mediation)
13. CONSUMER PROTECTION PROVISIONS
In accordance with Croatian consumer protection legislation:
- Passengers have the right to a refund in case of defective service
- You have the right to file a complaint with competent consumer protection authorities

14. MAINTENANCE AND SERVICE AVAILABILITY
- We strive to ensure continuous application availability, but we cannot guarantee 100% uptime
- We reserve the right to temporarily suspend service due to maintenance or technical issues
- We bear no responsibility for losses incurred due to application unavailability

16. MISCELLANEOUS
- If any provision of these Terms is deemed invalid, the remaining provisions remain in force
- We cannot transfer our rights and obligations without your consent
- You may transfer your rights and obligations only with our written consent
- These Terms constitute the complete agreement between you and us regarding the use of the application
